1. Purchase and Contract
The purchase of Charles Simon luxury accessories and luggage ("Products") through the www.charles-simon.com website ("Site") constitutes a contract of sale ("Contract") between Charles Simon Inc. ("Charles Simon" or "we") and you ("Customer"). The Contract is formed upon completion of an order and payment in accordance with Article 4.
2. Product Authenticity and Description

Charles Simon guarantees the authenticity of its luxury watch and travel items. Product descriptions and illustrations on the Site are for information purposes only and may slightly vary. Consequently, you accept that such differences may occur and acknowledge that Charles Simon cannot be held responsible for such fluctuations.

Variances apply to colors due to different screen calibrations, leather shade variations due to the artisanal tanning process, slight deviations across separate Alcantara® fabric batches, and individual wood characteristics due to every log’s unique pattern.
3. Warranty

Charles Simon stands behind the quality of our products by offering a warranty. Our luggage and large accessories collections, including the Mackenzie Watch Briefcase, Mackenzie Briefcase, Spence, Taylor, Bonaventure, and Rupert, come with a ten-year conventional warranty. For all other products, a two-year warranty is provided from the date of delivery, covering defects in materials or workmanship.

It is important to note that this warranty does not cover normal wear and tear. Additionally, exclusions include damages caused by scratches, dents on wood or leather during transportation by third-party carriers, repairs or modifications conducted by anyone other than Charles Simon, stains on leather, Alcantara, or wood, misuse leading to damage or breakage to mechanisms or latches, force majeure events, and damages caused by water, including storage in wet conditions.

The warranty is applicable only for the specified period and is subject to specified conditions. However, this warranty does not affect your legal rights as a consumer. Charles Simon's liability under this warranty is limited to the actual purchase price paid by the customer. It's essential to note that the warranty cannot be assigned unless prior notification to Charles Simon is made, particularly if the product is intended as a gift.

To initiate a repair or claim under this warranty, please reach out to our Customer Service team at info@charles-simon.com for assistance. Please be aware that the warranty does not cover any transport or delivery costs associated with the product, and these costs are the responsibility of the customer. Charles Simon reserves the right to choose between repairing, exchanging, or refunding the product to fulfill the warranty.
3.1 Warranty Activation from Retailers

The warranty for products purchased through authorized retailers can be activated by contacting Charles Simon at info@charles-simon.com.

To initiate the warranty, the Customer must provide proof of purchase, including but not limited to a valid sales receipt or invoice. The Customer shall specify the product details, including the model name or number, to facilitate accurate warranty activation. Please also share your personal details, including full name and email, for record-keeping and communication purposes. Charles Simon reserves the right to request supplementary documentation deemed necessary for warranty validation.

Upon successful verification, the purchaser will receive confirmation of warranty activation.
4. Sale and Pricing
Sale is confirmed upon completion of the ordering process and payment. Unless otherwise stated, prices on the Site exclude sales taxes and shipping charges, which are specified separately.
5. Shipping and Payment

Unless expressly mentioned otherwise, the prices displayed do not encompass delivery charges.

For deliveries outside Canada, the recipient is responsible for any customs fees and local taxes, in addition to the posted price on the Site. We recommend consulting your local customs agency for comprehensive information.

For each order, a shipping notification email will be sent, providing the carrier's name and available tracking information.
6. Payment and Ordering Process
6.1 Payment Methods:

Payments are accepted via methods supported by the secure online platforms Shopify Payments and PayPal.

You agree to cover all associated costs, including duties, taxes, shipping, and handling when applicable.
6.2 Responsibility for Payment:

You are solely responsible for the actual payment of the purchased product.

If payment cannot be validated or processed, your order will not be delivered, and Charles Simon is not obligated to process the order.

Charles Simon is not liable for payment issues related to the operation of the secure online payment systems.
6.3 Alternative Purchase Methods:
If you prefer to purchase by phone or e-mail, please contact Customer Service.
6.4 Ordering Process:

Place the selected product in your virtual shopping cart and proceed to the virtual checkout.

During your initial purchase on the Charles Simon website, please provide the necessary information.

Choose delivery preferences and pay the product's selling price, applicable taxes, and delivery charges.

To complete the order, press the "pay now" icon, indicating your agreement to the terms and conditions.
6.5 Order Accuracy and Billing:

Correct any errors promptly by notifying Customer Service via email.

Upon order completion, you'll receive a confirmation email with the paid invoice and digital Contract.
6.6 Correction Period:

You have thirty (30) days from invoice receipt to request corrections if errors are proven.

After this period, the information on your invoice is deemed accurate.
6.7 Customer Declarations:

By completing an order, you confirm legal age and declare that children under sixteen (16) are prohibited from purchasing via the site.

Purchases are solely for personal consumption, not for resale or commercialization.

Personal information provided for billing must be accurate, and you confirm being the valid credit card holder/owner of the PayPal account.

6.9 Acceptance of Orders and Cancellation Period

Receipt of an email confirmation does not automatically mean Charles Simon accepts the order.

Charles Simon reserves the right to cancel or refuse orders for various reasons, including product unavailability, pricing errors, payment issues, or delivery impossibility.

Additional verification or information may be requested before order acceptance.

After 24 hours, a fee of up to 25% of the sales price may apply in the case of order cancellation. Orders placed through the Bespoke Service cannot be canceled (see section 7.2)
7. Bespoke Service and Special Orders

Our Bespoke Service allows you to create unique, handcrafted accessories tailored to your vision.

Any product featuring customized aspects that are not available to purchase directly on the Site are considered bespoke items. Bespoke product customizations include initials hot stamping, name engraving, personal lock code, custom color combinations, etc.

View renderings to visualize and refine your bespoke accessory. Renderings serve to showcase options, aid the decision process and are for information purposes only. Slight variations in the color shades and product details may apply and Charles Simon cannot be held responsible for such fluctuations.
7.1.4 Price Confirmation:
The price for bespoke items varies by case, depending on the chosen materials, colors and personalization options. The final rate of the product is determined and confirmed in the sent invoice and/or payment link.
7.1.5 Order Finalization and Payment
Collaborate with your assistant to confirm and finalize details. Your Bespoke order is confirmed upon reception of the payment.
7.1.6 Shipping Period
The required shipment period for bespoke orders varies according to the chosen materials, product availability, and production volume. The manufacturing time might vary from what is initially communicated by the Bespoke Service assistant
7.2 Return Policy
Bespoke items are non-returnable, non-exchangeable, and non-refundable.
8. Delivery and Damages

Products are dispatched based on the chosen option during order placement, as specified in your invoice.

Charles Simon holds no liability for delays or clerical errors in the delivery address attributable to you, or for delays due to force majeure.

Moreover, Charles Simon is not responsible for any delays or damages caused by the logistics company.

Any damage to delivered Products must be reported within 72 hours of receipt. Please contact Customer Service promptly. After this period, the Product is considered received in perfect condition.

In the event of returning a defective or damaged Product to Charles Simon, if the original packaging is compromised, indicating damage upon delivery, Charles Simon reserves the right to return the Product, retaining the sale price.
9. Return Policy
In accordance with the allowances outlined in the Consumer Protection Act (Quebec) (chapter P-40.1), when applicable, our Site offers a 14-day return policy. This period starts upon your item's receipt, granting you 14 days to request a return.
9.1 Eligibility Criteria:
For a successful return, ensure your item is in its original condition – unused, with tags, and in the original packaging. A valid receipt or proof of purchase is required.
9.2 Initiating a Return:
Contact us at info@charles-simon.com to start the return process. Upon acceptance, we'll provide instructions on where and how to send the package. Items returned without prior approval will not be accepted.
9.3 Bespoke Items and Non-Returnable Items:
All bespoke items are considered final sale and are not eligible for returns or exchanges. In addition, sale items and gift cards are also non-returnable.
9.4 Return Processing Fee:
Charles Simon reserves the right to charge up to 25% of the sales price (before taxes) for accepted returns.
9.5 Damages and Issues:

Inspect your order upon receipt. Report any defects, damages, or discrepancies within 72 hours to Customer Service for evaluation and resolution.

In the event of returning a defective or damaged Product to Charles Simon, if the original packaging is compromised, indicating damage upon delivery, Charles Simon reserves the right to return the Product, retaining the sale price.
9.6 Exchanges:
The quickest way to receive your desired item is to return the original and make a separate purchase for the new item once the return is accepted.
9.7 Refunds:
Upon receiving and inspecting your return, we'll notify you of the refund approval. Approved refunds are processed automatically to your original payment method. Please note that your bank or credit card company may require time to process the refund.
9.8 Return Shipping Costs:
Charles Simon covers return shipping costs for cases of incorrect products or defects in materials or workmanship. For other cases (e.g. change of mind, exchange), you are responsible for the return shipping costs
10 Return Instructions
If your return has been accepted, please consult the following instructions for general reference. However, a member of the Charles Simon team will reach out to you with personalized instructions that are tailored to your order and situation. Please follow the precise instructions provided to you.
10.1 Packaging:

The returned Product must be in original condition (unused and complete with original packaging).

Ensure the Product is well packaged to avoid damage during shipping.

Charles Simon is not responsible for return shipping costs or items damaged or lost during the return process.
10.2 Shipment:

Create a shipping label and an invoice to return the Product.

To facilitate the return process and avoid complications at customs, we strongly recommend using the same shipping provider and same location as the initial shipment.

Share the tracking information with Charles Simon once available.

11. Jurisdiction and Applicable Laws
Governing laws are Quebec and Canada’s, excluding the United Nations Convention on Contracts for the International Sale of Goods. Disputes fall under federal/provincial jurisdiction, with exclusive courts in Montreal.
12. Modification

Charles Simon may change Terms of Purchase without notice. Applicable terms are those at the time of order placement, prevailing over other provisions.

You declare that you have read these Terms of Purchase and agree to be bound by them. However, the terms and conditions set out below shall prevail over the Other Provisions.
